This Recruitment Refund and Cancellation Policy (“Refund Policy”) is issued by Royal Sense Limited (“RSL”) to provide transparency concerning payments, refunds and cancellations associated with recruitment-related services offered in connection with vacancies of RSL.

This Refund Policy should be read together with: 1.RSL’s Recruitment Disclaimer Policy; 2.RSL’s Recruitment Privacy Policy; 3.the applicable candidate terms and conditions; 4.the terms applicable to any separately identifiable service offered by an independent recruitment-support service provider; and 5.applicable law.

1. General Principle – RSL Does Not Charge for Employment

1.1RSL does not require a candidate to pay an application fee, registration fee, recruitment fee, interview fee, placement fee, security deposit or other amount merely for:

  1. a.applying for employment with RSL;
  2. b.being considered for employment;
  3. c.being shortlisted;
  4. d.attending an interview;
  5. e.participating in RSL’s selection process; or
  6. f.obtaining employment with RSL.

1.2No payment to any person or entity guarantees or improves a candidate’s prospects of interview, shortlisting, selection, appointment or employment with RSL.

1.3RSL retains exclusive authority concerning final selection, rejection, compensation, employment conditions, appointment and joining.

2. Third-Party Recruitment-Support Services

2.1RSL may engage an independent recruitment-support service provider, including Brandexo Global Private Limited (“BGPL”), for limited recruitment-support activities.

2.2BGPL or another authorized service provider may, only where permissible under applicable law and subject to the applicable contractual arrangements, offer a separately identifiable service directly to a candidate.

2.3Any such candidate-paid service must be separate from RSL’s decision concerning whether the candidate will be interviewed, shortlisted, selected or employed.

2.4Payment for such a separately identifiable service shall not constitute payment to RSL unless RSL expressly states otherwise in writing.

3. Disclosure Before Payment

Before a candidate is required to make payment for any separately identifiable service, the entity collecting the payment should clearly disclose, as applicable:

  1. a.its legal name;
  2. b.the nature and scope of the service;
  3. c.the amount payable;
  4. d.applicable taxes;
  5. e.the circumstances in which the amount is refundable or non-refundable;
  6. f.the cancellation procedure;
  7. g.the applicable terms and conditions;
  8. h.grievance/contact details; and
  9. i.that payment does not guarantee an interview, shortlisting, selection, appointment or employment with RSL.

The candidate should be given a reasonable opportunity to review the applicable terms before making payment.

4. Payments Collected by BGPL

4.1Where BGPL independently collects payment from a candidate for a separately identifiable service provided by BGPL, BGPL shall be responsible for:

  1. a.issuing the appropriate receipt/invoice;
  2. b.applicable taxes;
  3. c.providing the service;
  4. d.cancellation requests;
  5. e.processing eligible refunds;
  6. f.payment disputes;
  7. g.maintaining payment and refund records;
  8. h.candidate grievances relating to such payment; and
  9. i.compliance with applicable law.

4.2Unless RSL itself has collected the relevant payment or has expressly undertaken responsibility for it in writing, a payment made to BGPL shall not be treated as money received by RSL.

4.3Candidates seeking a refund of an amount independently collected by BGPL should ordinarily submit the refund request directly to BGPL through BGPL’s notified refund/ grievance mechanism.

5. Circumstances in Which Refund May Be Available

Subject to the terms applicable to the relevant service and applicable law, a refund may be considered where:

  1. a.payment has been debited more than once for the same transaction;
  2. b.an amount has been successfully received but the paid service cannot be provided because of a technical or administrative failure attributable to the service provider;
  3. c.payment was collected for a service that the service provider subsequently cancels before providing it;
  4. d.an incorrect amount has been collected because of a demonstrable payment or system error;
  5. e.the candidate cancels within a cancellation period expressly offered for the relevant service;
  6. f.a refund is expressly provided under the terms applicable to the service; or
  7. g.a refund is otherwise required under applicable law.

6. Circumstances Ordinarily Not Giving Rise to a Refund

Subject always to applicable law and the specific terms disclosed before payment, a candidate shall not ordinarily become entitled to a refund merely because:

  1. a.the candidate is not shortlisted by BGPL or RSL;
  2. b.the candidate does not receive an interview from RSL;
  3. c.the candidate is unsuccessful in an interview or assessment;
  4. d.RSL does not select the candidate;
  5. e.RSL selects another candidate;
  6. f.the candidate does not receive an offer of employment;
  7. g.the candidate disagrees with RSL’s recruitment decision;
  8. h.the candidate's application is rejected because the candidate does not satisfy the relevant eligibility or recruitment criteria; or
  9. i.the candidate changes their mind after a separately purchased service has already been substantially or fully performed.

6.1The above circumstances do not automatically create a refund entitlement because payment for an authorized separately identifiable service is not consideration for obtaining employment with RSL.

6.2However, nothing in this clause shall restrict any refund or other remedy that a candidate is entitled to under applicable law.

7. Cancellation or Withdrawal of An RSL Vacancy

7.1RSL may, subject to applicable law, modify, postpone, suspend, withdraw or cancel a recruitment vacancy or recruitment exercise.

7.2Cancellation, suspension or modification of an RSL vacancy does not automatically determine whether a candidate is entitled to a refund from an independent service provider.

7.3Where a candidate has paid for a separately identifiable service and the withdrawal or cancellation of the vacancy means that the service cannot be provided at all, the service provider shall determine and process the appropriate refund or other remedy in accordance with:

  1. a.the nature and extent of the service already performed;
  2. b.the terms disclosed to the candidate before payment; and
  3. c.applicable law.

7.4Where no part of the paid service has been provided and the service cannot be provided because the relevant recruitment process has been cancelled, the service provider should refund the amount where required by the applicable terms or law.

8. Withdrawal by the Candidate

8.1A candidate may withdraw from an RSL recruitment process by notifying the appropriate recruitment contact.

8.2Withdrawal from the recruitment process does not automatically create an entitlement to a refund of charges paid for a separately identifiable service.

8.3Where the candidate seeks cancellation of a separately purchased service before it has been performed, the applicable cancellation/refund terms of the service provider shall apply, subject to applicable law.

9. Duplicate or Excess Payment

9.1Where a candidate reasonably believes that:

  1. a.payment was debited more than once;
  2. b.an amount greater than the disclosed charge was debited; or
  3. c.payment was debited despite a failed transaction,

the candidate should promptly notify the entity that collected the payment.

9.2The candidate may be requested to provide:

  1. a.candidate/application identification;
  2. b.transaction reference;
  3. c.payment date;
  4. d.amount;
  5. e.payment receipt;
  6. f.bank/payment-gateway reference; and
  7. g.such other information reasonably necessary to verify the transaction.

9.3Verified duplicate or excess payments shall be addressed in accordance with applicable law and the applicable payment-service procedures.

10. Payment Gateway Transactions

10.1Payments for a separately identifiable service may, where applicable, be processed through an authorized third-party payment gateway or payment-service provider.

10.2The payment gateway may independently process payment information in accordance with its applicable terms and privacy notice.

10.3A payment-gateway transaction appearing on a website, page or interface associated with an RSL recruitment process does not by itself mean that RSL is the recipient or beneficiary of the payment.

10.4The identity of the entity receiving the payment and providing the paid service should be clearly disclosed to the candidate before payment.

11. Payment Through RSL Website or Recruitment Interface

Where an authorized payment facility for a BGPL-provided service is technically made accessible through RSL’s website or recruitment interface:

11.1the candidate shall be informed before payment that the relevant paid service is being provided by BGPL;

11.2the candidate shall be informed, where applicable, that the payment is being collected for BGPL or by BGPL and is not a recruitment fee payable to RSL;

11.3the payment page should identify the relevant service and applicable amount;

11.4the applicable BGPL terms, refund/cancellation policy and privacy information should be made available before payment;

11.5the candidate should be required to acknowledge that payment does not guarantee employment, selection or interview with RSL; and

11.6BGPL shall remain responsible for refunds and candidate payment disputes attributable to its separately provided service, unless RSL has expressly agreed otherwise in writing.

12. Refund Request Procedure

Where BGPL is the relevant service provider and payment recipient, a candidate seeking a refund should submit a request to:

BRANDEXO GLOBAL PRIVATE LIMITED

Refund/Grievance Email
[email protected]

The request should ordinarily include:

  1. a.candidate's name;
  2. b.registered email address/mobile number;
  3. c.application/reference number, if applicable;
  4. d.payment date;
  5. e.amount paid;
  6. f.transaction/reference number;
  7. g.service purchased;
  8. h.reason for requesting refund; and
  9. i.supporting documents where applicable.

13. Review of Refund Request

13.1The relevant service provider shall review a properly submitted refund request in accordance with its applicable terms and applicable law.

13.2Additional information may reasonably be requested where necessary to verify the payment or refund claim.

13.3A request for additional information shall not be used merely to unreasonably delay an otherwise valid refund.

13.4Where a refund request is rejected, the candidate should be informed of the decision and, where appropriate, the principal reason for rejection, subject to applicable law.

14. Method of Refund

Where a refund is approved, it should ordinarily be processed to the original payment method, where technically and legally feasible.

Where refund to the original payment method is not reasonably possible, an alternative lawful method may be used after appropriate verification.

Candidates should not be required to disclose passwords, PINs, OTPs or other authentication credentials for receiving a refund.

15. Refund Processing Time

Approved refunds should be initiated within the period specified in the applicable service terms and in accordance with applicable law.

The time required for the amount to appear in the candidate’s account may additionally depend upon the bank, card network, UPI service, payment gateway or other payment-service provider involved.

16. RSL's Role in BGPL Refund Disputes

16.1Where BGPL has independently collected a payment for a separately identifiable service, BGPL shall remain primarily responsible for addressing the related refund request.

16.2RSL may, where appropriate, require BGPL to investigate or provide information concerning a candidate complaint connected with an RSL recruitment process.

16.3RSL's receipt, forwarding, review or facilitation of a candidate complaint shall not by itself constitute an admission that RSL received the payment, provided the paid service or is legally liable for the refund.

16.4Nothing in this clause limits liability that may otherwise arise under applicable law.

17. Unauthorized Payments and Recruitment Fraud

17.1Candidates should immediately exercise caution where any person:

  1. a.demands money in RSL’s name;
  2. b.claims payment is required by RSL to secure employment;
  3. c.guarantees employment in return for payment;
  4. d.demands payment into a personal account while claiming to act for RSL;
  5. e.issues a suspicious appointment or offer letter; or
  6. f.otherwise seeks payment outside an authorized recruitment/payment process.

17.2Payment made to an unauthorized person or fraudulent third party is not automatically a payment to RSL or BGPL.

17.3Candidates who suspect fraud should promptly contact the appropriate RSL recruitment/grievance contact and, where appropriate, their bank/payment provider and competent authorities.

18. Chargebacks and Payment Disputes

Where a candidate raises a payment dispute or chargeback with a bank, card issuer, payment gateway or other payment-service provider, the entity that received the payment may provide relevant transaction records to the payment provider to the extent necessary and permissible under applicable law.

Nothing in this Refund Policy prevents a candidate from exercising lawful rights available through the applicable payment system.

19. Records of Payments and Refunds

BGPL or the relevant service provider shall maintain appropriate records concerning candidate payments, receipts, invoices, refund requests, refunds and related communications in accordance with applicable law and applicable contractual obligations.

RSL may seek relevant information from BGPL where reasonably necessary to investigate suspected unauthorized charging, fraud, candidate complaints or compliance concerns relating to an RSL recruitment process.

20. Personal Data Relating to Refunds

Personal data collected in connection with a refund request may be processed for:

  1. a.identifying the candidate;
  2. b.verifying the relevant transaction;
  3. c.assessing the refund request;
  4. d.preventing fraud;
  5. e.processing an approved refund;
  6. f.maintaining accounting and compliance records;
  7. g.responding to disputes; and
  8. h.complying with applicable legal requirements.

Such information shall be handled in accordance with the applicable privacy policy and applicable law.

21. No Employment Guarantee

A refund, refusal of a refund, cancellation of a paid service or payment dispute shall not determine the candidate’s employment eligibility or create any right to employment with RSL.

RSL’s recruitment decision shall remain independent of any candidate payment made for a separately identifiable third-party service.

22. Candidate Grievances Involving RSL

Where a candidate alleges:

  1. a.money was demanded specifically in RSL’s name;
  2. b.the candidate was falsely informed that RSL required payment;
  3. c.employment with RSL was guaranteed in exchange for payment;
  4. d.RSL’s name, logo or identity was misused;
  5. e.a fake RSL appointment/offer letter was issued; or
  6. f.an unauthorized person represented themselves as acting for RSL,

the candidate may report the matter to:

ROYAL SENSE LIMITED

Recruitment Privacy/Grievance Email
[email protected]
Registered Office
C-7, Phase-3, Badli Industrial Area, Delhi-110042

Where possible, candidates should preserve and provide relevant messages, emails, receipts, screenshots and transaction details.

23. No Waiver of Statutory Rights

Nothing contained in this Refund Policy is intended to exclude, restrict or waive any refund, consumer, privacy, contractual or other right or remedy that cannot lawfully be excluded, restricted or waived.

Where this Refund Policy conflicts with a mandatory requirement of applicable law, the mandatory legal requirement shall prevail to the extent of the inconsistency.

24. Amendment of Policy

RSL may amend this Refund Policy from time to time to reflect changes in its recruitment arrangements, payment mechanisms, third-party service-provider arrangements or applicable legal requirements.

Any revised version may be published through RSL’s authorized recruitment website, portal or other appropriate channel.

Changes shall operate prospectively to the extent required by applicable law and shall not extinguish rights already accrued to a candidate.

25. Relationship with Other Recruitment Documents

This Refund Policy should be read together with:

  1. a.RSL’s Recruitment Disclaimer Policy;
  2. b.RSL’s Recruitment Privacy Policy;
  3. c.applicable candidate Terms and Conditions;
  4. d.the applicable terms governing any separately identifiable service provided by BGPL or

another third-party service provider; and

  1. e.the specific disclosures displayed before payment.

In the event of inconsistency, mandatory provisions of applicable law shall prevail.

26. Important Candidate Notice

RSL DOES NOT REQUIRE PAYMENT MERELY TO APPLY FOR, BE INTERVIEWED FOR, BE SELECTED FOR OR OBTAIN EMPLOYMENT WITH RSL.

PAYMENT FOR ANY LAWFUL, SEPARATELY IDENTIFIABLE SERVICE PROVIDED BY BGPL OR ANOTHER INDEPENDENT SERVICE PROVIDER DOES NOT GUARANTEE OR IMPROVE A CANDIDATE’S PROSPECTS OF INTERVIEW, SELECTION, APPOINTMENT OR EMPLOYMENT WITH RSL.

BEFORE MAKING ANY PAYMENT, CANDIDATES SHOULD VERIFY THE IDENTITY OF THE SERVICE PROVIDER, THE SERVICE BEING PURCHASED, THE AMOUNT PAYABLE AND THE APPLICABLE REFUND/CANCELLATION TERMS.

27. Candidate Acknowledgement Before Payment

Where an authorized candidate-paid service is offered through a recruitment portal or payment interface, the following acknowledgement may be required before payment:

“I acknowledge that I have read and understood the applicable service description, Recruitment Disclaimer, Privacy Policy and Refund and Cancellation Policy. I understand that the amount being paid is for the separately identified service described to me and is not consideration for securing employment with Royal Sense Limited. I understand that payment does not guarantee or improve my prospects of interview, selection, appointment or employment with Royal Sense Limited. I understand that any refund will be governed by the applicable Refund and Cancellation Policy and applicable law.”

I have read Acknowledged, understand, agreed & accepted the above.
